Please read these Terms of Service (“Terms”) carefully before using the Services operated by Modish Global Inc. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
1. About Modish Global Inc.
Modish Global Inc. is a Nevada C-Corp (EIN-registered, SAM.gov compliant) operating as a licensing-first, AI-powered architectural visualization and media infrastructure company. Our Services include the Modish.Ai™ iOS application, the 3D Transformative Digest™ digital publication, the DesignVault 3D™ render library platform, and the Modish.Ai Federal Division website at modish.ai. All proprietary IP, render libraries, and platform assets are held by Modish.Ai LLC (Delaware).
2. Acceptance of Terms
By creating an account, subscribing, or otherwise accessing our Services, you represent that: (a) you are at least 18 years of age; (b) you have the legal authority to enter into these Terms; and (c) your use of the Services complies with all applicable laws and regulations.
3. Subscription Services
The 3D Transformative Digest™ is available through the following subscription tiers: Digital Monthly ($7/month), Digital Annual ($69/year), and Redesign + Print + Digital ($180/year). Enterprise licensing is available upon request. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting federal@modish.ai.
4. Payment Terms
All payments are processed through Stripe, Inc. By providing payment information, you authorize Modish Global Inc. to charge the applicable subscription fee. All fees are in USD. Refunds are issued at our discretion within 7 days of initial purchase for annual subscriptions. Monthly subscriptions are non-refundable after the billing cycle begins. We reserve the right to modify pricing with 30 days’ notice to subscribers.
5. Intellectual Property
All content, renders, designs, publications, software, and AI-generated outputs produced by Modish Global Inc. and Modish.Ai LLC are protected by U.S. and international copyright, trademark, and trade secret laws. The following are proprietary marks of Modish Global Inc.: Modish.Ai™, 3D Transformative Digest™, DesignVault 3D™, and Cinematic Intelligence™. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from our Services without express written permission. Enterprise white-label licensing is available under separate written agreement.
6. Permitted Use
You may access and use our Services for lawful personal or professional purposes. You may not: (a) use our Services to infringe any third-party intellectual property rights; (b) reverse engineer, decompile, or disassemble any part of our software or AI models; (c) use automated tools to scrape, crawl, or harvest content; (d) attempt to gain unauthorized access to any part of our systems; (e) use our Services for any unlawful purpose or in violation of any federal, state, or local law.
7. Government and Federal Use
Modish Global Inc. is registered on SAM.gov and compliant with federal procurement requirements. Government agencies and federal contractors accessing our Services for official purposes do so subject to applicable federal acquisition regulations. Separate government visualization contracts are governed by their respective contract terms.
8. Modish.Ai™ iOS Application
The Modish.Ai™ iOS application delivers AI-powered architectural visualization. Your use of the app is also governed by Apple’s App Store Terms of Service. The app generates cinematic redesigns using our proprietary Cinematic Intelligence™ methodology. All AI-generated outputs remain the intellectual property of Modish.Ai LLC unless expressly licensed to you under a separate agreement.
9. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MODISH GLOBAL INC. AND MODISH.AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Modish Global Inc., Modish.Ai LLC, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
12. Termination
We reserve the right to suspend or terminate your account and access to our Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Services ceases immediately.
13. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Nevada. You consent to personal jurisdiction in such courts.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new effective date. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
